Limited Liability Release

Important notice

THIS LIMITED LIABILITY RELEASE AND ASSUMPTION OF RISK AFFECTS LEGAL RIGHTS. READ IT CAREFULLY. It applies only to Mine-Pro and the Mine-Pro software Service. It does not release your employer, mine operator, equipment owner, contractor, or any other workplace party from duties they owe under law.

1. Hazardous-work acknowledgement

I understand that mining, construction, heavy-equipment operation, maintenance, travel on mine property, blasting, excavation, hauling, dumping, processing, and related work can cause serious injury, illness, death, environmental harm, production loss, and property damage. Mine-Pro does not direct, supervise, inspect, or control that work and cannot identify or correct every hazard.

2. Software limitations

I understand that Mine-Pro is an administrative recordkeeping and workflow tool, not a substitute for training, examinations, inspections, competent-person judgment, equipment manuals, engineering, professional advice, hazard controls, emergency systems, or compliance with MSHA, OSHA, state, local, contractual, or site-specific requirements. Alerts, automated calculations, imports, AI-assisted extraction, reports, and status displays may be incomplete, delayed, inaccurate, or unavailable.

3. Assumption of Service-related risk

To the fullest extent permitted by law, I knowingly assume risks arising from my use of or reliance on the Service, including inaccurate or incomplete entries; unverified calculations or generated content; unauthorized account use; device or network failure; offline storage loss; synchronization delay, duplication, conflict, or rejection; third-party outages; and failure to maintain independent safety, communication, backup, or recordkeeping procedures. I will verify safety-critical and legally required information through authoritative sources before acting.

4. Release and waiver

To the fullest extent permitted by law, I release and discharge Mine-Pro and its owners, affiliates, licensors, service providers, officers, employees, and agents from claims, demands, and causes of action arising from ordinary negligence connected with my access to or use of the Service, including claims involving software errors, unavailable features, inaccurate outputs, delayed or failed delivery, and loss or corruption of data. This release does not apply to gross negligence, willful misconduct, fraud, or any liability that applicable law does not allow to be released or limited.

5. No transfer of statutory duties

Nothing in this Release transfers to Mine-Pro or reduces any duty imposed on a mine operator, employer, contractor, supervisor, competent person, certified person, equipment operator, or other regulated party. Nothing waives workers' compensation rights, protected reporting, whistleblower rights, or claims against a party other than Mine-Pro. I must follow the safest applicable law, site rule, instruction, and equipment procedure regardless of anything displayed by the Service.

6. Emergency and stop-work responsibility

I will not use Mine-Pro as the sole method for emergency notice, hazard warning, dispatch, equipment lockout, medical response, rescue, or evacuation. If conditions are unsafe or uncertain, I will stop work when authorized or required, warn affected persons through established channels, secure equipment or the area, and contact appropriate supervision or emergency services without waiting for the Service.

7. Voluntary electronic acceptance

I confirm that I can decline this Release by not using the Service and signing out, that I had an opportunity to read and retain it, and that no statement inside the Service overrides it unless Mine-Pro signs a written amendment. By checking the separate Limited Liability Release checkbox and clicking Accept and continue, I intend to sign this Release electronically for the version and effective date displayed.

8. Severability and law

This Release is governed by Texas law. If any part is invalid or unenforceable, it will be narrowed only as much as necessary and the remaining provisions will continue. The liability limitations in the Terms of Service also apply and are incorporated into this Release.
