Academy purchase & training terms
Version 2026-09-27.2 · Effective September 27, 2026
These terms apply in addition to the Terms of Service and Limited Liability Release. Save or print this page for your records.
1. Academy seats and access
Mine-Pro Academy is a separate course offering. A purchase grants the named customer the stated number of non-transferable learner seats for the identified course version. A learner may access protected lessons only after a verified payment and seat assignment, or while the learner's organization has an active Mine-Pro subscription that includes the Academy course. A checkout return screen, pending order, invoice, or buyer account alone does not grant access.
The customer must use real learner identities and may not share accounts or redistribute lesson content. Completed statutory training records remain available as required by law even when course access ends or a payment is refunded; a refund does not erase a record or undo training actually received.
2. What the course does and does not provide
The annual-refresher course provides general Part 46 surface-mine safety lessons, visual scenarios, checks for understanding, and guided exercises. It is intended for mines and persons to which 30 CFR Part 46 applies. Other catalog descriptions are not available courses until explicitly marked as open for purchase. Mine-Pro is not MSHA, does not claim MSHA approval or endorsement, and cannot guarantee that a particular course alone will satisfy every operator's legal obligations.
The mine operator or employing contractor remains responsible for its written and current training plan, applicability, miner classification, required subjects, competent-person designations, instruction on changes at the mine, site-specific hazards, task training and practical evaluation where applicable, and access to required records. Mine-Pro supplies exercise prompts; the trainer must still teach the real conditions and procedures at the mine.
3. Actual hours, certification, and records
Annual refresher training requires at least eight hours actually received, not merely eight planned hours, a fast completion of screens, a passing quiz, or a manager's unverified checkbox. The platform credits bounded, active online instruction and documented instructor-led sessions; it does not credit idle time. The designated responsible person must review the evidence and certify only training actually completed. Falsifying a training record is prohibited and may carry penalties under federal law.
Mine-Pro will make the signed digital PDF available in the learner's Academy account immediately after certification and aim to email a private download link within 24 hours. The learner chooses and confirms a U.S. postal address before the company signs. Mine-Pro will prepare and mail one physical copy within seven calendar days after certification; transit time after dispatch depends on the carrier. The learner may provide a corrected address for a returned copy. We keep fulfillment status and limit postal address access to the learner and authorized Mine-Pro mailing staff.
A downloadable completion display is not a substitute for the training record required by 30 CFR 46.9. The operator must keep required records, provide copies to miners when required, and make records available at the mine for inspection. If the service is unavailable, use the operator's independent training and recordkeeping process.
4. Buyer authority, price, taxes, and refunds
The buyer represents that they are authorized to purchase seats for the organization, assign learners and receive invoices. The checkout shows the applicable seat count, unit price, subtotal and any calculated tax before payment. Purchases are one-time course-seat purchases, not recurring Operations subscriptions. Any refund request is evaluated under the checkout terms and applicable law; no statement here limits a non-waivable statutory refund right. Seats from a fully refunded order cannot start new instruction.
An active eligible Mine-Pro application subscription includes access to this Academy course for its authorized workforce without a second purchase. A subscription's own contract controls its term and licensed-user capacity.
5. Safety, data, and legal terms
Training scenarios are educational, not instructions to operate equipment or enter a hazard. Follow current mine rules, equipment manuals, competent-person instructions and the safest applicable law. Stop work and use the site's emergency channels when conditions are unsafe. The buyer is responsible for lawful collection of employee identity and training data; Mine-Pro processes and protects records under its Terms of Service and applicable privacy notices.
These Academy terms supplement the Mine-Pro Terms of Service and Limited Liability Release. Nothing here shifts the mine operator's statutory duties, releases Mine-Pro from liability that law does not permit to be waived, or waives a miner's protected rights. A signed enterprise agreement controls if it expressly conflicts with these Academy terms.
